This website (“Site”) is provided by First Nations Information Governance Centre (FNIGC) as a service to our clients (“yourself”).  Please review the following terms and conditions that govern your use of this Site (the "Agreement"). The FNIGC provides you access to this Site subject to the terms and conditions of this Agreement. Please note that your use of this Site constitutes your unconditional agreement to follow and be bound by these terms and conditions. FNIGC reserves the right to update or modify the Agreement at any time without prior notice. If the Agreement has been updated, FNIGC will post the updated/new Agreement on this Site and note the date that it was last updated.  Your use of this Site following any such posting constitutes your unconditional agreement to follow and be bound by the Agreement as changed.

IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MAY NOT USE THIS SITE.  FNIGC MAY IMMEDIATELY DENY ACCESS TO THE SITE IF YOU ARE FOUND TO HAVE BREACHED ANY OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. 

SALE OF PRODUCTS & SERVICES

The sale of products and services on this Site may be subject to additional terms that will be made available to you when you chose to place your order.

NO LIABILITY

FNIGC will not, under any circumstance, be liable in any way for any content of the Site, including, but not limited to, any errors or omissions in any material or content, or any loss or damage of any kind that you incur as a result of your use of, or your acting in reliance on, any material or content made available through the Service.

TECHNOLOGY

You are responsible for meeting the technological requirements of the Site and will verify that your computer functionality, ISP capabilities, and software meet the requirements of basic email functions, video viewing uploads, PDFs, and Internet access should any or all be required as part of the course. You recognize that it is your responsibility to make sure your technology works.

INTELLECTUAL PROPERTY

These Terms confer only the right to use the Site while these Terms and the specified license(s) are in effect, and they do not convey any rights of ownership in or to the Site or the content provided therein (Content). All right, title and interest, including without limitation any copyright, patent, trade secret or other intellectual property right in the Site and Content such as, but not limited to, videos, text and commentary remain the property of FNIGC. Any access provided to you under these Terms, and other data or materials that are prepared in the performance of such access thereunder, and all right, title and interest in the foregoing, belongs to FNIGC.

You agree not to distribute in any medium any part of the Website or Content without FNIGC’s prior written authorization. You agree not to reverse engineer or otherwise alter or modify any part of the Site or Content. 

You agree not to use any Content in conjunction with any stream-ripping, stream capture or similar software to record or create a copy of any Site content that is presented to you in streaming format.

METHOD OF PAYMENT

You may pay for your purchase using VISA, MasterCard, American Express or by cheque (prior approval required) and you authorize the FNIGC to charge the applicable card for the Purchase Price and you represent and warrant that you are the cardholder of the applicable card.  If your card is rejected by the card issuer, your order will not processed and FNIGC will have no obligation to fulfill your order.

All billing and registration information provided by you to the FNIGC must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms of Sale.

CANCELLATION, RETURNS, REFUNDS AND EXCHANGES

Prior to taking any course you may have certain statutory rights to cancel your order under applicable provincial consumer protection laws and FNIGC will respect all such laws.  However once the courses have begun there are no refunds or returns.
